Terms of Service & Acceptable Use Policy (AUP)
These Terms of Service and Acceptable Use Policy (AUP) govern your use of Floreboard. By accessing our platform, you agree to these terms, our content standards, and compliance rules.
1. Nature of Service & Pure Digital Delivery Only
B2B SaaS & Generative AI Platform: Floreboard is a cloud-based B2B Software-as-a-Service (SaaS) and generative AI (AIGC) platform designed for florists, floral designers, and botanical studios. It provides AI-assisted composition algorithms, recipe cost calculations, 4K digital image rendering, and cloud inventory tracking.
100% Digital Delivery Only: All products and services sold on Floreboard (including Pro Subscriptions and Credit Packs) are 100% digital software access and cloud compute credits. All purchased items are delivered immediately and electronically to your account upon payment completion.
No Physical Goods or Logistics Fulfillment: Floreboard does NOT sell, distribute, package, or ship fresh flowers, living plants, floral supplies, ceramic vases, or any physical merchandise requiring parcel/postal shipping. Floreboard does not provide human on-site floristry labor or offline event decoration services. All floral images generated on the platform are purely digital, AI-rendered conceptual drafts.
2. Account Registration and Access
You must register an account to access Floreboard design tools, inventory sync, and AI generation features.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
Notify us immediately at corlin@qq.com if you suspect unauthorized access.
2. Merchant of Record (MoR) & Payment Processing
All commercial transactions, credit pack purchases, and recurring subscriptions on Floreboard are processed by our authorized Merchant of Record (MoR), Waffo.ai.
Waffo securely processes your payment details, handles transaction tax compliance (sales tax/VAT), and manages billing records.
By initiating a purchase, you acknowledge and agree to Waffo’s checkout terms and compliance guidelines.
3. Credits and Subscription Plans
Credit Packs: Purchased credits are non-expiring and consumed per generation (1 credit per standard design generation, 5 credits per 4K high-resolution photorealistic render).
Pro Subscriptions: Recurring monthly or yearly plans automatically allocate credits each billing cycle. You can cancel your subscription at any time via Settings to prevent future renewals.
Upon cancellation, active subscription benefits remain accessible until the end of the current paid billing cycle.
4. Underlying AI Models Disclosure
To maintain full transparency and industrial design excellence, Floreboard explicitly discloses the underlying generative AI models deployed on our platform:
• Google Gemini / Nano Banana: Powers floral recipe reasoning, color harmony algorithms, and structured design prompt synthesis.
• FLUX.1 (Black Forest Labs): Deployed for photorealistic 4K commercial floral rendering, realistic ambient lighting, and petal macro-texture generation.
• OpenAI GPT Image (DALL-E 3) & Seedream: Utilized as redundant secondary and stylistic generation pipelines ensuring high uptime and diverse aesthetic expressions during peak volume.
5. Content Standards and Prohibited Categories
In strict compliance with international MoR and online safety standards, Floreboard strictly prohibits users from uploading, prompting, generating, or transmitting content in the following six categories:
1. Sexual / NSFW Content: Explicit pornography, nudity, sexually suggestive or erotic depictions, and any adult-oriented or non-consensual sexual material.
2. Violence / Gore: Extreme bloodshed, physical violence, gore, mutilation, self-harm, weapons depictions, or promotion of terrorism and harm.
3. Hate Speech: Defamatory, harassing, derogatory, or abusive content targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or age.
4. Child Unsafe Content: Any depictions of child sexual abuse material (CSAM/CSAS), endangerment, or exploitation of minors. We maintain zero tolerance and will immediately report violations to law enforcement agencies.
5. Deepfake / Impersonation: Non-consensual face-swapping, deceptive identity manipulation, false or misleading representations of real people, or defamatory celebrity deepfakes.
6. Copyright / Trademark Infringement: Unauthorized replication, counterfeiting, or commercial exploitation of registered brand trademarks, logos, copyrighted characters, or third-party intellectual property.
6. Enforcement Actions
If a user violates our Acceptable Use Policy or generates prohibited material, Floreboard reserves the right to take the following enforcement actions immediately without notice:
• Content Removal: Prompt and permanent deletion of any infringing or non-compliant content from our servers.
• Account Suspension or Termination: Temporary freeze or permanent ban of the user account.
• Forfeiture of Credits: Immediate forfeiture of all remaining credits and subscription balances without any refund or monetary compensation.
• Legal Referral: Escalation and reporting to pertinent regulatory and law enforcement authorities for severe or illegal violations.
7. User Reporting Channel
We provide an active, monitored reporting channel for intellectual property or content standard violations:
• Designated Reporting Email: corlin@qq.com
• Format: Please use the subject line "[AUP Report] Violation Details" and include the URL, account, or output identifier.
• Service SLA: Our safety team investigates and responds to reported violations within 24 to 48 hours.
8. Platform Content Moderation Process
Floreboard enforces a comprehensive three-tier content moderation pipeline:
1. Automated Pre-generation Filtering: Real-time keyword filtering and safety classifiers analyze prompt inputs prior to reaching generative AI APIs, blocking banned concepts.
2. Automated Post-generation Scanning: All generated visual outputs are analyzed by automated computer vision safety classifiers to detect NSFW, violence, or prohibited markers.
3. Human Review Escalation: Content flagged as borderline or reported by users is escalated to our dedicated human safety team for auditing and final action within 48 hours.
9. Intellectual Property & AI Generation Rights
User Inputs: You retain full ownership of all flower inventory data, custom vessel designs, and store assets uploaded to Floreboard.
AI Commercial Rights: To the fullest extent permitted by applicable law, you own the commercial rights to floral design schemes and rendered images generated for your account. You may freely use them for commercial floristry, client pitches, and marketing.
10. Disclaimers & Limitation of Liability
- Provided "AS IS" and "AS AVAILABLE": The Floreboard platform, software, generative AI algorithms (including Google Gemini, FLUX.1, OpenAI GPT Image, Seedream), visual outputs, and services are provided strictly on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, Floreboard explicitly disclaims and excludes all warranties of any kind, whether express, implied, statutory, or otherwise, including without limitation warranties of merchantability, fitness for a particular purpose, title, non-infringement, and error-free, uninterrupted, or virus-free operation. AI-generated floral compositions, color recommendations, and estimates are provided for advisory inspiration only and do not constitute physical craft or commercial outcome guarantees.
- Limitation of Consequential Damages: To the maximum extent permitted by applicable law, in no event shall Floreboard, its operators, parents, subsidiaries, affiliates, officers, directors, employees, agents, or suppliers be liable to you or any third party for any indirect, incidental, special, consequential, punitive, or exemplary damages, including without limitation damages for loss of profits, goodwill, business interruption, loss of data, or procurement of substitute goods or services, whether based on contract, tort (including negligence), strict liability, or any other legal theory, even if advised of the possibility of such damages.
- Cap on Aggregate Liability: In no event shall the total aggregate liability of Floreboard arising out of or related to your use of the service or these terms, whether in contract, tort, or otherwise, exceed the greater of: (a) the total amount actually paid by you to Floreboard for the service during the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars ($100.00 USD).

We may update these terms periodically. Continued use following modifications signifies acceptance.

1. 业务性质与纯数字化交付声明 (Nature of Service & Pure Digital Delivery)
【B2B 软件与生成式 AI 定位】：Floreboard（芳华绘）是一款面向花艺设计师及商业花店的 B2B 云端软件服务（SaaS）与生成式 AI（AIGC）创作工作台。平台提供数字化插花方案构思、花材损耗精算算法、4K 高清照片级渲染及云端数据管理功能。
【纯数字化商品与即时交付】：平台销售的所有产品与服务（包括 Pro 订阅会员、AI 算力点数加油包）均为 100% 虚拟数字化商品。交易完成后，相应权限与点数通过网络即时生效并注入您的用户账户，不产生任何实体等待期。
【严格排除实体商品与物流配送】：Floreboard 绝不销售、分发或寄送任何真实鲜花、盆栽植物、花瓶器皿或任何需通过快递/物流履约的实体商品。平台亦不提供任何线下人工插花、现场布置或人工上门劳务。平台所有展示之插花图片均为 AI 算法渲染的数字设计参考稿。
2. 账户注册与服务访问
您必须创建账户方可使用 Floreboard 的高级 AI 插花设计、方案管理及云端同步服务。
您需对保管自身账户凭证安全承担全责，并对在您账户下发生的所有活动负责。
若发现未经授权的账户访问，请立即通过 corlin@qq.com 通知我们。
2. 支付处理与记录商户 (Merchant of Record)
Floreboard 的所有付费交易、订阅管理及点数充值由第三方支付合规实体 Waffo.ai 担任法定记录商户（Merchant of Record, 简称 MoR）。
当您购买点数加油包或 Pro 订阅时，交易由 Waffo 安全承兑与处理。Waffo 负责相关的税务征收、银行清算、发票开具及结账合规支持。
购买即表示您同时同意 Waffo 的交易服务条款与隐私合规协议。
3. 点数体系与订阅规则
点数加油包（Credit Packs）：所购积分永久有效，按次消耗。每次生成花艺方案消耗 1 点，超高清 4K 商业级渲染消耗 5 点。
Pro 订阅会员：按月或按年定期自动计费并充入相应配额。在当前计费周期内享有高峰极速通道及高阶功能。
您可以随时管理或取消自动续订，取消后会员特权将持续至当前周期的截止日期。
4. 底层生图 AI 模型披露 (Underlying AI Models Disclosure)
为保障商业级设计与图像渲染的专业度，Floreboard 明确披露所集成的底层主流商业 AI 模型与算力引擎：
• Google Gemini / Nano Banana：用于花材配比逻辑推理、多维色彩美学分析、插花场景语义解析与结构化生图提示词生成。
• FLUX.1 (Black Forest Labs)：用于商业级超写实 4K 花艺光影渲染、高清花瓣微距纹理呈现与空间场景合成。
• OpenAI GPT Image (DALL-E 3) & Seedream：作为多引擎冗余与风格多样化渲染通道，保障极端高峰期的高可用服务与多样化花艺艺术风格。
5. 可接受使用政策与严禁生成类别 (Acceptable Use Policy & Content Standards)
为维护安全、健康的创意环境并符合国际 MoR 支付合规规范，Floreboard 严禁用户上传、提示、生成或分发以下六大类别的不良及违规内容：
1. 色情与成人内容 (Sexual / NSFW)：严禁包含裸露、色情、性行为暗示、露骨成人诱导或任何违背公序良俗的性相关内容。
2. 暴力与血腥 (Violence / Gore)：严禁包含肢体暴力、流血伤害、残害虐待、自残自杀、恐怖袭击或武器攻击等血腥暴力内容。
3. 仇恨言论与骚扰 (Hate Speech)：严禁基于种族、民族、宗教信仰、性别、性取向、残疾或年龄进行的任何歧视、侮辱、诽谤、人身攻击或仇恨煽动。
4. 儿童不安全内容 (Child Unsafe Content)：对任何危害、虐待、性剥削未成年人（CSAM/CSAS）的内容实行零容忍政策，一经发现将立即上报国际执法部门。
5. 深度伪造与冒用他人 (Deepfake / Impersonation)：严禁未经授权生成或利用真实人物形象制作欺骗性面部替换、虚假肖像、伪造名人代言或任何误导公众的欺诈性内容。
6. 侵犯版权与知名商标 (Copyright / Trademark Infringement)：严禁未经授权模仿、盗用受法律保护的知名商业品牌 Logo、受版权保护的卡通形象及第三方专有知识产权。
6. 违规处置措施 (Enforcement Actions)
若用户违反上述可接受使用政策（AUP）或生成禁止类别的内容，Floreboard 有权立即采取以下一项或多项合规处置措施：
• 立即删除下架：即刻从服务器与云存储中彻底删除侵权与违禁内容。
• 封禁账户权限：临时冻结或永久终止违规用户的账户访问权限。
• 没收剩余点数且不予退款：违规账户内剩余的付费点数或订阅权益将全额没收并注销，概不退款。
• 追究法律责任：针对严重涉嫌违法犯罪行为（如儿童安全、恐怖威胁等），我们将主动保留证据并报送司法执法机关。
7. 用户举报渠道 (User Reporting Channel)
我们建立了完善的用户监督与侵权违规举报渠道：
• 官方举报受理邮箱：corlin@qq.com
• 邮件主题规范：请在邮件标题注明【AUP 违规举报 / AUP Report + 关联详情】。
• 受理与反馈承诺：平台安全专员将在 24 至 48 小时内完成核实、违规处置并向举报人回复处理结果。
8. 平台内容审核与风控流程 (Content Moderation Process)
Floreboard 部署了严格的“前置机审 + 后置过滤 + 人工复核”三道安全防护机制：
1. 前置提示词过滤 (Pre-generation Filtering)：在调用 AI 模型推理前，系统自动通过违禁词库与语义安全模型拦截任何涉黄、暴、恐或违禁敏感提示词。
2. 后置图像机审 (Post-generation Scanning)：生成的渲染图像需经自动化计算机视觉安全分类器实时扫描，一旦触发高危违规阈值将直接阻断呈现。
3. 人工复核与工单仲裁 (Human Review Escalation)：针对边缘疑似案例或用户举报工单，由人工审核专员在 48 小时内进行二次复核与终局判定。
9. 知识产权与 AI 成果归属
用户资产归属：您上传的库存花材、定制花器及私人配置的所有权始终归属于您。
AI 生成商业权利：在适用法律允许的最大范围内，由 Floreboard 根据您需求生成的插花方案与渲染图像，其商业使用权归您所有，您可自由将其用于商业插花交付、花艺展示与客户提案。
10. 免责声明与责任限制 (Disclaimers & Limitation of Liability)
- 按“现状”与“可用”基础提供 (Provided "AS IS" & "AS AVAILABLE")：Floreboard 软件平台、AI 算法、生图功能及相关服务均严格按照“现状 (AS IS)”和“现有可用性 (AS AVAILABLE)”基础提供。在适用法律允许的最大范围内，Floreboard 明确否认并排除任何明示、默示、法定或其他形式的保证，包括但不限于适销性保证、特定用途适用性、所有权、不侵犯第三方知识产权、无错误 (Error-Free)、无病毒或永不中断运行的任何保证。AI 生成的插花配比、构图光影及色彩建议仅供花艺师参考，不构成对实际花材物理属性、制作存活期或最终商业交易结果的绝对担保。
- 间接与后果性损害赔偿排除 (Exclusion of Consequential Damages)：在法律允许的最大范围内，Floreboard 及其运营实体、母公司、子公司、关联方、高级职员、董事、雇员或技术供应商在任何情况下均不对您或任何第三方承担任何间接 (Indirect)、偶然 (Incidental)、特殊 (Special)、后果性 (Consequential)、惩罚性 (Punitive) 或惩戒性损害赔偿责任，包括但不限于因使用或无法使用本服务导致的利润损失、商誉损害、业务中断、数据丢失或替代服务采购费用，无论该索赔系基于违约、侵权（包括过失）还是其他法律理论，即使已被告知此类损害发生的可能性。
- 赔偿责任上限设定 (Cap on Total Liability)：在任何情况下，Floreboard 对您因使用本服务或本条款引起的或与之相关的所有索赔的累计最高赔偿责任总额，均不超过：您在导致该索赔的事件发生前十二 (12) 个月内就使用本服务向 Floreboard 实际支付的金额总和，或一百美元（$100.00 USD）（以金额较高者为准）。

5. 違規處置措施、舉報信箱與審核流程
- 處置措施：立即下架刪除內容、封禁帳號、沒收剩餘點數且不予退費。

- 審核流程：前置關鍵字過濾 + 生成後機器視覺安全掃描 + 人工復核。
6. 免責聲明與責任限制 (Disclaimers & Limitation of Liability)
- 按「現狀 (AS IS)」與「可用性」提供：本平台與 AI 生成功能不提供任何明示或默示擔保（包括適銷性、特定目的適用性或不侵權保證）。AI 配方僅供參考。
- 排除衍生損害賠償：在法律允許的最大限度內，排除任何間接、附帶、衍生性或利潤損失賠償責任。
- 賠償責任上限：累計賠償總額上限不超過用戶過去 12 個月內向本平台實際支付的金額或 100 美元（以較高者為準）。

【完全デジタル配信】：販売されるすべてのプランおよびクレジットは 100% デジタル商品であり、決済完了後即座にオンラインで有効化されます。
【物販・物流配送の完全排除】：本サービスは生花、観葉植物、花瓶等の実物商品の販売および物流配送を一切行いません。また、対面での生花装飾等の人的役務提供も行いません。
2. 販売代行事業者 (Merchant of Record)
決済処理および税務コンプライアンスは Waffo.ai が法定販売事業者（MoR）として安全に処理します。

1. アダルト・性交描写 (Sexual/NSFW)、2. 暴力・流血 (Violence/Gore)、3. ヘイトスピーチ (Hate Speech)、4. 児童の安全を脅かす表現 (Child Unsafe)、5. ディープフェイク・なりすまし (Deepfake/Impersonation)、6. 著作権・商標権侵害 (Copyright Infringement)。
4. 違反への対処・通報窓口・審査プロセス
- 措置：コンテンツの即時削除、アカウントの凍結・削除、未使用クレジットの没収（返金不可）。
- 通報窓口：corlin@qq.com（24〜48時間以内に調査および対応）。
- 審査プロセス：生成前のプロンプト自動フィルタリング + 生成後の画像自動AI検知 + 人手によるエスカレーション審査。
5. 免責事項および責任の制限 (Disclaimers & Limitation of Liability)
- 「現状有姿 (AS IS)」および「提供可能な範囲」での提供：AI レンダリングおよび提案機能は保証なしで提供され、商品性・特定目的への適合性・権利非侵害の保証を明示的・黙示的に否認します。
- 間接損害の免責：法令上許容される最大限の範囲で、いかなる間接的・派生的損害や利益の損失についても一切の責任を負いません。
- 損害賠償額の上限：本サービスに関連する当社の賠償責任総額は、過去12ヶ月間にお客様が実際に支払った利用金額または100米ドルのいずれか高い方を上限とします。
